Labor Code Section 2810.5 Notice Updated To Reflect Paid Sick Leave Options

With the recent revision, the "Notice to Employee", which employers are required to provide to all employees upon hire, are now available in English, Spanish, and Vietnamese.

The addition of the paid sick leave component communicates (in summary) the rights of employees entitled to the new mandated leave. It also requires employers to select one of four options which accurately reflects how the company provides paid sick leave to its employees.

The new paid sick leave law includes a provision which obligates employers to effectively communicate the new benefit to their employers through proper notifiication. The revised 2810.5 Notice is considered an acceptable and preferred method in documentating and notifying employees of the the new mandate and how the employer provides the leave.

In accordance with the new law, employers are required to provide the revised Notice to Employer to all new hires hired on or after January 1, 2015. For existing employees hired prior to January 1, 2015, a Notice should be provided to them by July 1st, but no later than July 8th. Although exempt employees are exempt from receivng a Notice, they are covered under the new paid sick leave law and, therefore, should receive a Notice to ensure compliance under the law.
